The Partner Visa program includes three primary subclasses, but it can be broadly categorized into two main types: the Prospective Marriage Visa and the Partner Visa. The appropriate visa category for your situation will depend on the nature of your relationship.
Types of Relationships and Corresponding Visas:
- Intended Marriage (Fiancé(e)): Prospective Marriage Visa
- Married (De Jure) Relationship: Partner Visa
- De Facto Partner Relationship (including same-sex relationships): Partner Visa
Subclass Partner Visa
The subclasses are of two types: temporary and permanent. In the The Partner Visa subclasses are divided into two types: temporary and permanent. Initially, applicants who meet the legal criteria are granted a temporary visa. After a specified eligibility period, or sooner if the relationship is well-established or includes children, a permanent visa may be granted.
Additionally, the Partner Visa program allows for the temporary entry of fiancés (intended spouses) of Australian citizens, permanent residents, and eligible New Zealand citizens.
As the partner or fiancé(e) of an Australian citizen, Australian permanent resident, or eligible New Zealand citizen, you are not automatically entitled to permanent residency in Australia. To obtain permanent residency, you must first apply for a permanent visa and be assessed against the legal criteria for that visa.
Here is an overview of the partner subclass visas based on your location at the time of application:
- If you are in Australia: You are eligible to apply for the Partner Temporary Visa (Subclass 820) and the Partner Permanent Visa (Subclass 801). This visa allows you to stay in Australia with your partner, who must be an Australian citizen, permanent resident, or eligible New Zealand citizen. If your relationship is genuine and continues for two years following your visa application, you may be granted a permanent visa.
- If you are outside Australia: You can apply for the Partner Temporary Visa (Subclass 309) and the Partner Permanent Visa (Subclass 100). This visa enables you to enter and stay in Australia with your partner, who must be an Australian citizen, permanent resident, or eligible New Zealand citizen. A continuous and genuine relationship for two years after your visa application may lead to the grant of a permanent visa.
Prospective Marriage Visa (Subclass 300)
The Prospective Marriage Visa (Subclass 300) is designed for individuals who wish to enter Australia to marry their fiancé(e). To be eligible for this visa, your fiancé(e) must be an Australian citizen, Australian permanent resident, or eligible New Zealand citizen. After marriage, visa holders can apply for a Partner Visa to pursue permanent residency in Australia.
General Terms and Conditions
To qualify for this visa, you must meet the following general requirements:
- Sponsorship: You must be sponsored by your fiancé(e), partner, or, in some cases, a parent or guardian of your partner. The sponsor must be an Australian citizen, Australian permanent resident, or eligible New Zealand citizen and must fulfil the legal requirements for sponsorship.
- Health and Character: You must meet the specified health and character criteria.
- Dependents: If you have dependent children or other dependent family members, they may be included in your application, provided they meet certain criteria.
